1. Overview

This website is operated by Pevori ("Pevori", "we", "us" or "our").

These Terms of Service ("Terms") apply to your access to and use of the Pevori website, including purchases of products and subscriptions made through our online store.

By accessing our website, creating an account, placing an order or purchasing a subscription, you agree to these Terms and any policies incorporated into them by reference.

If you do not agree to these Terms, you should not use the website or place an order.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law (ACL).

2. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms is intended to exclude, restrict or modify your statutory consumer rights.

Depending on the circumstances, if goods fail to satisfy an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, compensation or another remedy provided by law.

Our Pevori policies, guarantees and other benefits are provided in addition to any rights you have under applicable law.

3. Online Store

We operate an online store offering pet-care and related products.

You must provide accurate, complete and current information when placing an order, including your name, delivery address, contact information and payment information.

You are responsible for checking your order information before submitting your order.

We may reasonably refuse or cancel an order where, for example:

a product is unavailable;
there has been an obvious pricing or listing error;
payment cannot be authorised;
we reasonably suspect fraud or unauthorised activity;
an order breaches applicable law; or
we cannot reasonably fulfil the order.

If we cancel an order after payment has been successfully collected and no goods are supplied, we will provide an appropriate refund.

4. Products and Product Information

We make reasonable efforts to display our products and their descriptions accurately.

Product packaging, colours, appearance and other minor details may differ from photographs displayed on the website, including because of differences in screens, packaging updates or supplier changes.

However, nothing in this section limits your rights where a product is materially different from its description or otherwise fails to comply with an applicable consumer guarantee.

You should read product descriptions, instructions, warnings and other information before using a product.

5. Pet Care Information

Information provided through the Pevori website is intended as general pet-care information only.

It is not veterinary advice and is not intended to diagnose, treat, cure or prevent any disease, illness or medical condition.

Individual animals have different health conditions, sensitivities and requirements. Where appropriate, consult a qualified veterinarian before using a new product, particularly if your pet has an existing medical condition, injury, allergy or sensitivity.

If your pet experiences an unexpected or concerning reaction, discontinue use where appropriate and seek veterinary advice.

Nothing in this section excludes any responsibility Pevori has under applicable consumer or product-safety laws.

6. Prices

Unless otherwise stated, prices displayed on the Pevori website are in Australian dollars (AUD).

The price applicable to an order is the price displayed and agreed to at checkout, subject to correction of genuine and obvious errors as permitted by law.

Applicable shipping charges, discounts and other charges will be displayed at or before checkout where relevant.

Where taxes are applicable, they will be handled in accordance with applicable law and the information presented at checkout.

7. Payment

Payment must be made using one of the payment methods available at checkout.

Payments may be processed by third-party payment providers. Your use of a particular payment method may also be subject to that provider's terms and conditions.

Submitting an order does not necessarily mean it has been accepted. We may verify payment and order information before fulfilling an order.

8. Shipping and Delivery

For Australian customers, Pevori currently offers:

Our estimated standard delivery timeframe is:

7–14 business days.

Delivery estimates are estimates rather than guaranteed delivery dates unless we expressly state otherwise.

Delivery may occasionally be affected by circumstances outside our reasonable control, including carrier delays, severe weather, customs or border processing, public holidays or other transportation disruptions.

We will nevertheless comply with our obligations under applicable law.

9. Delivery Information

Customers are responsible for providing accurate delivery information.

Please check your delivery address carefully before completing your order.

If you notice an error after placing an order, contact us as soon as possible. We will make reasonable efforts to assist, but we may not be able to change an address once an order has been processed or dispatched.

Nothing in this section affects rights you may have where a delivery problem is caused by Pevori or otherwise gives rise to rights under applicable law.

10. Subscriptions

Certain Pevori products may be available as recurring subscriptions.

When purchasing a subscription, the available frequency and recurring price will be clearly displayed before you complete your purchase.

Pevori currently offers eligible subscription intervals such as:

every 4 weeks;
every 6 weeks; or
every 8 weeks.

Eligible subscription products may receive a discount compared with the applicable one-time purchase price. The actual subscription price displayed when you subscribe forms part of your purchase agreement.

11. Automatic Recurring Billing

Subscriptions automatically renew and involve recurring payments.

By purchasing a subscription, you authorise the applicable payment provider to charge your selected payment method for each recurring order according to the subscription frequency and price disclosed when you subscribe, subject to any changes made in accordance with these Terms and applicable law.

Your subscription continues until cancelled in accordance with the applicable cancellation process.

We will not intentionally conceal the recurring nature of a subscription or represent a recurring purchase as a one-time transaction.

12. Managing Your Subscription

Where supported by our subscription platform, customers may be able to manage eligible aspects of their subscription through their Shopify customer account or subscription-management portal.

Available functionality may include:

viewing subscriptions;
skipping eligible upcoming orders;
pausing or resuming a subscription where available;
cancelling a subscription;
updating eligible payment information; and
updating eligible shipping information.

Certain changes may require you to contact Pevori.

13. Cancelling a Subscription

You may cancel your subscription using the cancellation methods made available through your customer account/subscription-management system or by contacting Pevori where assistance is required.

Cancellation prevents future subscription renewals after the cancellation becomes effective.

If an order has already been processed before a cancellation request takes effect, cancelling the subscription does not necessarily cancel that already-processed order.

Any rights you have under Australian Consumer Law, including in relation to faulty or non-compliant products, continue to apply.

There is no cancellation fee merely for cancelling a Pevori subscription unless a specific fee has been clearly disclosed and is lawful. Pevori currently does not intend to charge a standard subscription cancellation fee.

14. Subscription Price Changes

If we change the price or other material terms applicable to an existing subscription, we will handle the change in accordance with applicable law and any requirements of the subscription platform.

Where required, appropriate notice will be provided before the changed terms apply.

We will not rely on these Terms to impose undisclosed charges retrospectively.

15. Returns, Refunds and 90-Day Guarantee

Eligible purchases may be covered by the Pevori 90-Day Guarantee.

Our voluntary 90-day change-of-mind guarantee generally requires eligible products to be:

unopened;
unused; and
in their original condition.

The Pevori 90-Day Guarantee is an additional benefit and does not replace or restrict your rights under Australian Consumer Law.

Products purchased through a subscription have the same applicable statutory consumer protections as products purchased as one-time purchases.

16. Faulty, Damaged or Incorrect Products

If you receive a product that you believe is faulty, damaged, unsafe, incorrect, materially different from its description or otherwise fails to comply with an applicable consumer guarantee, please contact us.

We may reasonably request information necessary to investigate the problem, such as your order information, a description of the issue and, where reasonably appropriate and available, photographs or video.

Any request for evidence will be administered consistently with your statutory rights.

17. Promotions and Discount Codes

Promotional offers may be subject to additional conditions disclosed with the promotion.

Unless otherwise stated or required by law:

discount codes cannot necessarily be combined;
discounts may apply only to eligible products or orders;
promotions may have expiry dates;
certain offers may be limited to one use per customer; and
subscription and one-time-purchase promotions may have different eligibility requirements.

We may refuse the fraudulent or unauthorised use of a promotional offer.

Nothing in this section allows Pevori to withdraw or alter an offer in a manner prohibited by applicable law.

18. Intellectual Property

Unless otherwise stated, the Pevori website and Pevori-created content appearing on it, including branding, logos, text, graphics, design elements and original website content, are owned by or licensed to Pevori and are protected by applicable intellectual-property laws.

You may use the website for personal, non-commercial shopping and informational purposes.

You must not reproduce, distribute, commercially exploit or misrepresent Pevori-owned material without permission, except where permitted by law.

Third-party trademarks, product images and other materials remain the property of their respective owners.

19. Reviews and Customer Content

If you submit a review, photograph, comment or other content directly to Pevori, you represent that you have the right to submit that material and that it does not unlawfully infringe another person's rights.

We may moderate or remove content where reasonably necessary, including content that is unlawful, fraudulent, abusive, misleading, spam, unrelated to the product or infringes another person's rights.

We will not knowingly alter genuine customer feedback in a way that materially misrepresents the customer's opinion.

Where reviews or feedback displayed on our website originate from third-party marketplaces or other external sources, we may identify them accordingly where appropriate.

20. Acceptable Use

You must not misuse the Pevori website.

This includes attempting to:

commit fraud;
interfere with the website's operation or security;
introduce malicious software;
gain unauthorised access to systems or accounts;
scrape or exploit the website in an unlawful manner;
impersonate another person; or
use the website for unlawful purposes.

We may take reasonable steps to protect our website, customers and business from such conduct.

21. Third-Party Services

Our store may use services provided by third parties, including Shopify, payment processors, shipping providers and subscription-management services.

Some website functionality may therefore be subject to the availability and operation of third-party systems.

Links to third-party websites are provided for convenience where applicable. Pevori does not control all third-party websites or their content.

Nothing in this section excludes any liability Pevori has under applicable law.

22. Website Availability

We aim to keep the Pevori website accurate, secure and available, but uninterrupted website availability cannot be guaranteed.

The website may occasionally be unavailable because of maintenance, technical problems, platform outages or circumstances beyond our reasonable control.

Where legally permitted, we may modify website functionality from time to time.

23. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

To the extent permitted by law, Pevori is not responsible for losses caused solely by circumstances outside our reasonable control or by a customer's misuse of a product contrary to applicable instructions or warnings.

Any limitation contained in these Terms applies only to the extent permitted by law.

24. Privacy

Your personal information is handled in accordance with our Privacy Policy and applicable privacy laws.

Please review our Privacy Policy for information about how personal information may be collected, used, stored and disclosed.

25. Changes to These Terms

We may update these Terms where reasonably necessary, including to reflect changes to our business, products, website, technology or applicable law.

The version published on our website will state its most recent update date.

Changes will not be applied retrospectively in a manner that unlawfully removes rights you have already acquired or imposes undisclosed obligations on completed purchases.

Where required by law, we will provide appropriate notice of material changes affecting existing subscriptions or ongoing agreements.

26. Governing Law

These Terms are governed by the laws applicable in Australia and, where relevant, the laws of the Australian State or Territory applicable to the transaction.

Nothing in this section is intended to deprive a consumer of protections or rights that cannot lawfully be excluded by choosing a particular governing law.

27. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or severed to the minimum extent necessary, while the remaining provisions continue to apply where legally possible.
